Supply material to the improvement

The definition of “material” in section 1 of the Builders Lien Act is broad and includes more than what might ordinarily be considered “material”:

“material” means movable property that is delivered to the land on which the improvement is located and is intended to become part of the improvement, either directly or in a transformed state, or is consumed or used in the making of the improvement, including equipment rented without an operator
(Builders Lien Act, s. 1).

The definition of material indicates that the material supplied must be movable property that:
1.      becomes part of the improvement, either directly or in a transformed state;
2.      is consumed in the making of the improvement; or
3.      is used in the making of the improvement, including equipment rented without an operator.
